Alot of laws like that have parts that say each case is at the officers discretion if he or she wants to pursue the law on each case, unless the person is overly visible to be breaking the law. They mainly made that law so officers have the power to arrest someone for breaking that law if they feel they are a danger to someone, that way they can get them before they get behind the wheel and such. But they know people will drink, and if they are outside waiting for a taxi they know it's ok to leave them alone. But like if they see someone walking to their car and are obviously drunk then the law is there so they can stop them before they even get in the car, and such.... they have something similar to that here in michigan, we no longer had a DUI law it's now an OUI operating under the influence, if they see you riding a bike, roller skating, even driving a lawn mower home from the bar they can stop you and take you in. It's all for people they feel will be a danger...
